These Terms & Conditions (“Terms”) govern your access to and use of the Fate Finger mobile application (the “App”) and any related services (together, the “Services”). By downloading, accessing, or using the App, you agree to these Terms.
If you do not agree, do not use the App.
1) Who we are
The App is operated by Liam McEvoy (“we”, “us”, “our”).

2) Eligibility and age requirements
You must be at least 13 years old to use the App.
Some content (including certain dare packs) may be intended for 18+ audiences. If content is marked 18+ (or otherwise adult-oriented), you confirm that you are 18 or older to access it.
You are responsible for ensuring the App is legal to use where you live.
3) Nature of the App (for clarity)
Fate Finger is a party game that displays prompts, dares, and/or challenges for entertainment. You are always in control of what you choose to do. You should only do activities that are safe, legal, consensual, and appropriate for your group and setting.
4) Safety, consent, and responsibility
You agree that:
Participation is voluntary, and you can skip any prompt at any time.
You will not do anything that is unsafe, illegal, humiliating, hateful, harassing, or violates anyone’s rights.
You will obtain clear consent from all participants before involving them in any activity.
You will not encourage or perform activities involving self-harm, violence, criminal acts, or dangerous stunts.
We are not responsible for injuries, damages, or disputes arising from gameplay or choices made by users.
If you feel unwell, unsafe, pressured, or uncomfortable, stop immediately.
5) Your account (if applicable)
If the App allows accounts or profiles:
You are responsible for keeping your login details secure.
You must provide accurate information and keep it updated.
You must not share your account or impersonate others.
We may suspend or terminate access if you breach these Terms.
6) Licence to use the App
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial entertainment purposes, subject to these Terms.
You must not:
Copy, modify, reverse engineer, or attempt to extract source code from the App (except to the extent permitted by law).
Use the App to build a competing product.
Circumvent paywalls, security, or access controls.
7) In-App Purchases, subscriptions, and payments
The App may offer paid features, including subscriptions, one-time purchases, or lifetime access (“Paid Features”).
Payments handled by Apple/Google
Payments are processed by the platform you downloaded the App from (e.g., Apple App Store or Google Play). Your purchase is also subject to the platform’s terms.
Subscriptions
If you purchase a subscription:
It will auto-renew unless cancelled at least 24 hours before the end of the current billing period (platform rules may vary).
You can manage or cancel your subscription in your device’s Account Settings (App Store / Google Play).
Free trials (if offered)
If a free trial is offered:
You may be charged automatically when the trial ends unless you cancel before the end of the trial period.
Pricing changes
We may change pricing or available plans. If required, we’ll provide notice via the App or platform mechanisms.
Refunds
Refunds are handled by Apple/Google under their policies. We can’t issue platform refunds directly unless the platform allows it.
8) User-generated content (custom dares, names, etc.) (if applicable)
If the App lets you submit content (e.g., custom dares, player names, text) (“User Content”):
You retain ownership of your User Content.
You grant us a worldwide, non-exclusive, royalty-free licence to host, store, display, reproduce, and use your User Content for operating and improving the App.
You must not submit User Content that:
Is illegal, threatening, harassing, hateful, discriminatory, sexually exploitative, or violent.
Infringes anyone’s intellectual property, privacy, or other rights.
Contains personal data of others without consent (e.g., phone numbers, addresses).
We may remove User Content at any time.
9) Prohibited conduct
You agree not to:
Use the App to bully, harass, threaten, or shame others.
Encourage dangerous, illegal, or non-consensual behaviour.
Upload malware, scrape data, or interfere with the App’s operation.
Attempt to bypass limitations or Paid Features.
10) Intellectual property
The App, including its design, text, graphics, dare packs (except user-submitted content), trademarks, and code are owned by us or our licensors and are protected by intellectual property laws.
You may not use our brand assets without permission.
11) Third-party services
The App may integrate third-party services (e.g., analytics, crash reporting, payment providers). Your use of those services may be subject to their terms and policies.
12) Privacy
Our collection and use of personal information is described in our Privacy Policy: www.fatefinger.com/privacy-policy.
By using the App, you consent to our handling of information as described there.
13) Disclaimers
To the maximum extent permitted by law:
The App is provided “as is” and “as available.”
We do not guarantee the App will always be available, error-free, or uninterrupted.
We do not guarantee any particular outcome from using the App (including “fun,” social results, or gameplay quality).
14) Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses arising from your use of the App.
Our total liability for any claim relating to the App is limited to the amount you paid (if any) for the App or Paid Features in the 12 months before the claim arose, or AUD $100, whichever is greater.
Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies you may have under the Australian Consumer Law or other applicable laws that cannot be excluded.
15) Indemnity
You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses (including legal fees) arising from:
Your use of the App,
Your breach of these Terms,
Your User Content, or
Your violation of any law or rights of a third party.
16) Suspension and termination
We may suspend or terminate your access to the App at any time if we believe you have breached these Terms or if required to comply with law.
You may stop using the App at any time. Termination does not affect rights or obligations that should survive termination (e.g., IP, liability limitations, indemnities).
17) Changes to the App or Terms
We may update the App and these Terms from time to time. If changes are material, we will provide notice within the App or by other reasonable means.
By continuing to use the App after changes take effect, you agree to the updated Terms.
18) Governing law
These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of NSW.
